A DOB violation does not go away when you fix the problem. It goes away when the right paper is filed with the right proof and the city accepts it. Here is the process, in the order it actually happens.
Step 1: Identify which kind of violation you have
- ECB / OATH violation. A summons with a hearing date and a penalty. These become judgments and liens if ignored. Found in OATH’s and DOB’s records with a number that starts with 3.
- DOB violation. No hearing, no immediate penalty, but it blocks permits, Certificates of Occupancy, refinancing and sales until dismissed. Elevator, boiler, electrical, plumbing and facade violations are common examples.
- Orders. A Stop Work Order, vacate order or padlock order is not a violation but comes with one, and has its own rescission process.
Step 2: Correct the condition
Use a licensed trade for licensed work: a master plumber for gas and plumbing, a licensed electrician, a registered architect or engineer for anything structural or anything that needs drawings. Keep invoices, photographs with dates, and any inspection reports. The city will ask for them.
Step 3: File the correction
- For an ECB / OATH violation, file a Certificate of Correction with DOB, signed by the owner and, where required, the licensed professional who did or inspected the work, with the proof attached. DOB reviews and either accepts it or sends it back with what is missing.
- For a DOB violation, file the dismissal request that matches the type, usually through DOB NOW, often with a passed inspection or a professional’s sign-off. Boiler and elevator violations are dismissed through their own annual-inspection filings.
- For a Stop Work Order, correct the condition, pay the civil penalty or set the hearing, and submit the rescission request.
Step 4: Handle the hearing
An OATH summons has a hearing date. You can appear, send a representative, or in many cases admit and pay. Mitigation is real: a corrected condition, proof of good faith and a clean history reduce penalties. If the date passed, a default judgment was entered at the maximum; a motion to vacate the default gets you back in front of a hearing officer. The OATH / ECB guide covers this in detail.
Step 5: Confirm it closed
Check DOB BIS or DOB NOW and the OATH record two to four weeks later. “Corrected” is not the same as “dismissed” and an accepted Certificate of Correction is not the same as a resolved summons. Pull the record until each item reads closed, then keep the acceptance letters with the building file.
What typically goes wrong
- Filing the correction without the licensed professional’s signature the type requires, so it bounces.
- Fixing the condition but never filing, and finding the violation years later at a refinance.
- Missing the OATH date and paying the default maximum when mitigation would have cut it.
- Clearing the summons but not the underlying DOB violation, so the next permit application stalls.
